Remote Support Terms and Conditions

PLEASE REVIEW THESE TERMS AND CONDITIONS CAREFULLY. BY CLICKING THE LINK TO DOWNLOAD OUR REMOTE SUPPORT TOOL YOU INDICATE YOU AGREE WITH TERMS & CONDITIONS AND AUTHORIZE TECHNICIAN TO BEGIN.

1. TeamViewer proprietary software ("TeamViewer") has been or is about to be downloaded to your computer to allow a remote control session between Ultimate Setup LLC. ("Ultimate Setup") and a computer or computers on your network. By initiating this download by clicking the link, you are authorizing Ultimate Setup to download TeamViewer to your computer and you understand that Ultimate Setup will have partial or fully unrestricted access to this computer or computers on your network as well as their contents on your network. Ultimate Setup will then be able to transfer files with our without additional authorization from you. If you are in any way unsure about the identity, technical ability or trustworthiness of Ultimate Setup about to download TeamViewer and do not wish Ultimate Setup to have access to your computer, do not click the download link. 
2. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST, ULTIMATE SETUP’S ENTIRE LIABILITY FOR YOUR DAMAGES FROM ANY CAUSE WHATSOEVER WITH RESPECT TO THE REPAIR OF YOUR PRODUCT, WHETHER DUE TO ULTIMATE SETUP’S NEGLIGENCE OR TO ANY OTHER REASON, IS LIMITED TO THE AMOUNTS THAT YOU PAY FOR REPAIR SERVICES. ULTIMATE SETUP HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, SUCH AS LOST PROFITS OR REVENUE. ULTIMATE SETUP ALSO HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS. YOUR ONLY REMEDY UNDER THIS REPAIR AGREEMENT IS TO SEEK RECOVERY OF DAMAGES AGAINST ULTIMATE SETUP IN AN AMOUNT NOT TO EXCEED WHAT YOU HAVE PAID FOR REPAIR SERVICES.
3. All remote support cases are billed a $25.00 connect fee and $35.00 for each additional 30 minutes, if necessary. A major credit card is required for remote support and will be run for the fee BEFORE the session begins. For your convenience we accept MasterCard, Visa, and Discover Card. After you have authorized repair, you will be responsible for any charges incurred even if you decide later to cancel the repair. 
4. After remote connection has ended the credit card will be charged for the full amount according to the above mentioned fee structure. You agree to pay for service performed on your product; Ultimate Setup reserves the right to refuse service as well as change fees and rates at any time without notice.
5. You grant Ultimate Setup permission to download and install software on your product.
6. If it is necessary to reinstall your operating system, you will be responsible for providing the original disks and a Certificate of Authenticity prior to the reinstall. 
7. Ultimate Setup warrants (1) that the repairs will be performed in a competent and workmanlike manner and (2) that all parts used to repair your product will be free from defects in materials and workmanship for a period of thirty (30) days, unless otherwise specified by Ultimate Setup. The warranty on parts is an express limited warranty. If a defect exists in a replacement part during the part’s warranty period, at its option, Ultimate Setup will (1) repair the part, using new, used or reconditioned replacement parts, (2) replace the part with a new, used or reconditioned equivalent part, or (3) refund the fair market value of the part, as determined by Ultimate Setup. Standard Labor Services Charges will Apply for all Warranty Visits. THIS WARRANTY AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, WITH RESPECT TO THE REPAIR PARTS. ULTIMATE SETUP SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO SUCH PARTS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 
8. If repair service involves transferring information or installing software, you represent that you have the legal right to copy the information and agree to the terms of the software license, and you authorize Ultimate Setup to transfer the information and accept such terms on your behalf in performing the service.
9. You agree to release and hold harmless Ultimate Setup from any and all liability associated with the performance of service or the provision of parts, and acknowledges also that Ultimate Setup offers no explicit or implied warranty or guarantee on services performed or parts provided, other than the manufacturer's warranty.
10. You acknowledge that due to the nature of the services being performed, there is potential risk of damage, corruption, or loss of computer software, applications, data, and data storage media and you agree to release and hold harmless Ultimate Setup from any and all liability for such damages.
11. You grant Ultimate Setup, access, security rights, and permission to open, view, modify, edit, delete, or otherwise manipulate your computer software, applications, data, and data storage media including, but not limited to, the products operating system, word processing, spreadsheets, databases, workflow, graphics, audio, video, system drivers and libraries, and any other type of software or data that may be contained on your product.
12. These Terms and Conditions are the only ones that govern Ultimate Setup’s repair of your product. No other oral or written terms or conditions apply, including ones in any purchase order that you provide to Ultimate Setup. No one has the authority from Ultimate Setup to vary any of these Terms and Conditions.
13. Ultimate Setup strongly recommends that you safeguard critical data by backing up said data prior to any services performed by Ultimate Setup. Unless specifically requested and provided as a paid service by Ultimate Setup, you are responsible for any backup, archiving, or protective storage as well as restoration if required, of your data.
14. You acknowledge and agree that you have backed up all said data prior to Ultimate Setup visit.
15. In no case will Ultimate Setup be legally or financially responsible for any lost data, programs, operating systems, etc.
16. Data may be lost in transit or during repairs. Be aware that not all diagnostic procedures, reconfigurations, or repairs are reversible if you decide to cancel the repair. We may not be able to return the machine to you in exactly the same state as when you brought it in.
17. You accept that not all problems can be fixed and not all services can be performed remotely. Should a scheduled onsite visit be necessary, Ultimate Setup will inform you of this and schedule an appointment. You agree to pay service performed onsite separate from remote support conditions, charges and fee structure, subject to separate Terms and Conditions for onsite assistance.
